1. Identity of the seller and owner of the Site

The website fanyclothes.com (hereinafter, “the Site”) is owned by Nexora Digital Limited, a company incorporated in the Emirate of Abu Dhabi, United Arab Emirates, holder of economic licence no. MC 15057 (Masdar City Free Zone), with its registered address at FD – First Floor, Incubator Building, Masdar City, Abu Dhabi, United Arab Emirates and contact email address info@fanyclothes.com (hereinafter, “Fany Clothes”).

Nexora Digital Limited, the company named in the registered trade licence, owns, maintains and operates this website.

United Arab Emirates is our country of domicile and the governing law is the local law of the United Arab Emirates.

2. Purpose

These Terms and Conditions govern access to, browsing of and the purchase of products through the Site. Placing an order implies full and unreserved acceptance of these Terms and Conditions in the version in force at the time of purchase.

3. Products

Fany Clothes sells made-to-order clothing, footwear and accessories: each piece is produced to the customer’s specifications (size, finishes and, where applicable, personalisation) in limited editions. Product images are for guidance only; slight variations in colour or finish may occur as a result of the production process.

4. Ordering process and prices

Prices are shown in euros (€) and include the applicable indirect taxes, unless otherwise stated. Delivery charges and the customs surcharge of €3 per order applicable to deliveries within the European Union are itemised before the order is completed. Fany Clothes reserves the right to change prices at any time, without affecting orders already confirmed.

Payment and order confirmation: once your payment has been authorised you will receive, by email and immediately (normally within a few minutes), a confirmation of the payment and of the order stating the items, the amount and the currency charged. If you have not received this confirmation within 24 hours, please check your spam folder and write to us at info@fanyclothes.com. If you notice an error in your details, contact us immediately.

5. Payment, accepted payment methods and currencies

We accept Visa and Mastercard card payments through the secure payment gateways available on the Site. The accepted currencies are AED (United Arab Emirates dirham), EUR (euro) and USD (US dollar).

The displayed price and currency at the checkout page will be the same price and currency printed on the Transaction Receipt, and the amount charged to the card will be shown in your card currency, with your issuing bank applying the relevant exchange rate where applicable.

Fany Clothes does not store full payment card details and does not pass them to third parties; processing is carried out by PCI-DSS certified payment providers.

Cardholders must retain a copy of transaction records (email confirmation and receipt) and of the merchant policies and rules, and adhere to them.

6. User requirements

Minors under 18 years old cannot register as users or transact on the Site. By placing an order you declare that you are over 18 and have the legal capacity to enter into a contract.

Users are responsible for maintaining the confidentiality of their account and password, and for all activities carried out under them. If you suspect unauthorised use, notify us immediately at info@fanyclothes.com.

7. Sanctioned countries

Fany Clothes will not trade with or provide any services to OFAC-sanctioned countries (US Office of Foreign Assets Control) or to individuals or entities listed on its sanctions lists, in accordance with the applicable laws of the United Arab Emirates.

8. Returns policy — personalised products

In accordance with Federal Law No. 15 of 2020 on Consumer Protection of the United Arab Emirates and its implementing regulations, no returns or exchanges are accepted for the products sold on the Site, as they are goods made or personalised to the customer’s specifications. This condition is communicated before purchase. Please check the size, finishes and delivery details carefully before confirming your order.

9. Refunds, cancellations and defective products

The above does not affect your rights in the event of lack of conformity. If you receive a product that is wrong, defective, damaged in shipping or tampered with, Fany Clothes will replace it or refund its price. You must report the issue within 7 days of receipt, attaching photographs of the product and the packaging, to info@fanyclothes.com.

Refunds will be credited only to the original mode of payment used for the purchase and will be processed within 10 to 45 days, depending on the credit card issuing bank.

10. Liability

Fany Clothes shall not be liable for delays or failures caused by force majeure, the actions of third-party carriers or incorrect delivery details provided by the customer. Fany Clothes’s total liability shall be limited, to the fullest extent permitted by applicable law, to the amount of the order concerned.

11. Intellectual property

The contents of the Site (texts, design, own logos, photographs) are the property of Fany Clothes or its licensors. Their reproduction without prior written authorisation is prohibited.

12. Changes

The Website Policies and these Terms and Conditions may be changed or updated occasionally to meet the applicable requirements and standards. Customers are encouraged to frequently visit these sections to be updated about the changes on the Site. Modifications will be effective on the day they are posted.

13. Governing law and jurisdiction

Any purchase, dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of the United Arab Emirates. These Terms and Conditions are governed by the federal laws of the United Arab Emirates and the applicable regulations of the Emirate of Abu Dhabi. Any dispute shall be submitted to the exclusive jurisdiction of the Courts of Abu Dhabi, without prejudice to any mandatory consumer protection rules that may apply in the customer’s country of residence.
